Understanding Minnesota’s comparative fault laws

One issue that often comes up in personal injury cases is whether the victim of an accident can recover even if they were partly at fault for their injuries. In Minnesota, the answer is often yes. Minnesota follows a modified comparative negligence rule under Minn. Stat. § 604.01. That law allows you to recover compensation even if you were partially at fault for your accident, as long as your share of the fault doesn’t exceed 50%.

Instead of barring your recovery altogether, the court will reduce your compensation by your percentage of fault. So, if the court finds you 20% at fault and your damages are $100,000, you could still recover $80,000 from the party that was 80% at fault.
